After a car crash: when can legal cover help?

After a collision, somebody must establish liability and decide which insurer pays. Repairing your vehicle is one issue; enforcing a disputed claim is another. If the other side contests liability or an insurer rejects compensation, legal protection insurance may help assess and pursue your position. It only does so within the terms of your policy. The fact that a claim feels fair does not itself establish cover or guarantee a win.

What you can do now

  • Keep photos, contact details, the accident report and all correspondence.
  • Notify your legal protection insurer as soon as a dispute begins to emerge.
  • Ask whether this type of case is covered, which event date counts, and whether waiting periods, deductibles or exclusions apply.
  • Confirm your choice of lawyer and obtain approval for costs before commissioning paid legal work yourself.

A policy does not automatically pay every invoice or guarantee a successful case. Depending on its terms, it may provide legal assessment, advice, negotiation and covered litigation costs. A well-founded settlement can be a good result too. Before signing one, understand its effect and clarify what support is available. An existing dispute cannot simply be insured retrospectively.

Where the idea came from

The gap between suffering a loss and enforcing a claim helped give rise to legal protection in the early motor age. JUSTIS explains that history and its modern relevance in From a car accident to a legal dispute.
